Terms and conditions of assembly

 

I. The cooperation of the customer is necessary for the success of an installation and to avoid additional costs.

§ 1 Prior to the start of assembly, the customer shall name a person responsible for the execution and his representative to the assembly manager commissioned by us.

§ 2 General and assembly drawings (ground plan, height division of the storage levels) must be checked and approved by the customer before assembly begins.

§ 3 The foundation work must be completed in good time before the start of assembly so that the concrete has hardened sufficiently. The customer is responsible for the foundation work. Groundwork, masonry, carpentry, plumbing and electrical work shall be carried out by the customer.

§ 4 The floor tolerance must comply with the requirements according to DIN 18202, Table 3, line 3.

Larger unevenness must be levelled on site with suitable levelling compound. The floor must be structurally stable. Minimum requirement is concrete quality C20/25 according to EN 1992, provided that it has a corresponding compressive strength for the racking or mezzanine loads. If the floor contains a top layer containing magnesite, this must be indicated separately.

Anchoring of the racks, mezzanines and other components must be possible up to a floor depth of at least 150 mm. The presence of underfloor heating or similar installations must be indicated separately.

The assembly prices are calculated for normal concrete drilling. Should we encounter reinforcing bars in 15% of all drill holes, the drilling times will be extended and special drills will be required.


§ 5 The access routes must be such that the parts to be assembled can be brought directly to the assembly area by a 42 t. road lorry. The unloading of our lorries without waiting times and the transport of the materials to be assembled to the installation site or in its immediate vicinity (10 m) is a service provided by the customer. Unless otherwise agreed in the order, the timely provision of a suitable counterbalance forklift truck with a load capacity of 2 to. lifting capacity and corresponding lifting height (lifting height = shelf height or upper edge of platform), or assembly equipment as specified, is part of the customer's services.

§ 6 The assembly area must be prepared in such a way that our fitters can start work immediately and carry it out without hindrance. This includes that an additional traffic space of at least 5.0 m is to be kept free all around the assembly area. For the transport of components up to 12 m wide, it must be ensured that sufficiently large and wide entrances are available for the insertion of the components. Electrical power and current installations (230/400 volts) as well as light must be available at the installation site and must be provided free of charge.

§ 7. In the event that the customer provides its own material for the assembly, this shall be made available at the assembly area in good time, in full and in suitable quality. If the customer provides workers for the assembly, they must be qualified skilled workers (preferably skilled metalworkers).

§ 8. The customer shall take the necessary measures to protect persons and property at the assembly site. A suitable, lockable room in the immediate vicinity (10 m) of the assembly area must be provided for the parking and storage of assembly tools and aids. The customer must also inform the assembly supervisor of existing safety regulations, insofar as these are relevant for the assembly personnel. The necessary measures include that the customer ensures that no outside assemblers are in our work areas or unauthorised persons are on the construction site.

§ 9 The assembly site must be permitted and secured for welding and sawing work in accordance with the relevant accident prevention regulations. The customer is liable for this; any permits must be provided by the customer.

§ 10 The customer is obliged to provide a container for waste, such as packaging material, free of charge for the duration of the assembly. If it is not possible to provide a container, our assembly manager shall be allocated a place by the customer in the immediate vicinity of the construction site where waste and packaging material can be collected. If none of these possibilities can be used, the packaging material will be disposed of by the installation team at the customer's expense.

§ 11 If the aforementioned requirements are not or only partially fulfilled and additional costs are incurred by us as a result (e.g. downtime, additional work, travel costs, additional material), we shall be entitled to reimbursement of these additional costs.

 

II. costs for assembly, which are invoiced on an hourly basis, can be found in offers and order confirmations under the chapter "Note on assembly". The following costs are stated there:

1. assembly costs: per fitter per working hour

2. travel costs:

- Flat rate per kilometre travelled

- Flat rate per hour of travel per fitter

- Daily allowance for each fitter

3. the normal working time shall be 37 hours per week (Monday to Thursday 8 hours each, Friday 5 hours).

4. the following rates shall be charged for overtime worked and work on Saturday and Sunday:

for the first two hours + 25%

for the third and further hours + 50%

for night work between 8 p.m. and 6 a.m. + 25%.

for work on Saturday + 50%

Sunday work + 70%

work on public holidays + 100%

work on 1 January, 1 Easter Day, 1 May, 1 Whitsun Holiday, 1 and 2 Christmas Day + 150%.

Permission for work on Sundays and public holidays must be obtained from the customer.

If several surcharges coincide, only one surcharge is to be paid, and in the case of different surcharges, the highest one. The surcharge for night work is excluded from this. Times for the procurement of accommodation at the place of assembly shall count as working hours.

5. travel costs and travel expenses shall be calculated for one outward and one return journey. If the installation extends over one or more weekends, the trigger rates for non-working days or outward and return travel costs shall be paid. Should the assembly be interrupted through no fault of our own, new travel hours and travel costs shall be borne by the client.

6. the value added tax determined in accordance with the statutory provisions shall be charged on all amounts (clause 3.3 of the general terms and conditions).

7. Assembly invoices are due for payment immediately upon receipt and without deduction of any discount.
